II. Essential characteristics of the subject of the contract
The following general terms and conditions apply to all webshops and all goods operated by Optitech Kft.
The technical information required for the use of the Website, which is not included in these General Terms and Conditions, is provided by the information available on the Website. A contract can only be concluded in the webshop in Hungarian. A contract concluded through the Website is not considered written and will not be registered. Our company does not refund VAT to foreign travelers.
 
III. Management of the webshop
 
In the online shop, you can find out about our products without placing an order. In this case, it is not necessary to provide your data. The products can be selected in a multi-level menu structure. Here you can choose from the products within the article group and view detailed image and text information.
 
With the Search function, we want to make shopping and selection easier, as you can search for a word or a fragment of a word in the product name and product description. For example, by entering the word “mp3” in the search field, all products that contain the term “mp3” will be listed.
 
You can find out the features of the selected product in detail on the information page of the given product. Although we always prepare the descriptive description of the products with the greatest care, it was prepared based on the latest known manufacturer data. We do not assume any responsibility for any inaccuracy. The images shown are sometimes illustrations.
 
The time of ordering the given product is the time when you send your order to the merchant through the store. The order you place is considered a pre-order until the start of delivery. You will receive an automatic confirmation of receipt of the order from our system, but your order will not be processed at this time, it is only for informational purposes and does not constitute an order confirmation. Your order will be processed within 24 hours (on business days) if possible, after we send you a confirmation of the status of the ordered goods (whether they can be delivered and when they are expected to be sent). Your order will be finalized when the delivery begins, and you will be notified by e-mail.
 
If this confirmation is not received by the Customer within 48 hours of sending the offer, the Service Provider's offer obligation and any other obligation of the Customer will automatically terminate without any further conditions.
 
The purchase price is always the gross price indicated next to the selected goods; the prices indicated do not constitute a direct quotation.
 
Our company is not liable for any damages resulting from any typos.
 
In the event of simultaneous purchases from multiple product groups, the delivery and payment terms for the goods belonging to each product group may differ; the provisions for each product group can be found in a separate appendix at the end of these terms and conditions.
 
The order data is stored by our company. If you would like to receive it in printed form, you can print out the "Order Confirmation". This will appear on the screen after you have submitted your order. After you have given us your email address, we will send you all the essential details of your order by email, which you can also print out.
 
IV. Order
 
Orders can only be placed electronically via the internet via the webshop. We cannot accept orders placed by phone, fax, email or letter.
 
Purchase process:
  1. Select a product.
  2. Click on the given product to display the detailed description of the product.
  3. To add the product to the Cart, click on the Cart button, and the contents of the cart will be displayed. This does not mean that the order is final. You can remove the selected product from the cart at any time without payment obligation, or add additional products.
  4. If you want to buy the product, click on the Start Order button
  5. Choose a shipping and payment method, enter your shipping and billing information. Of course, it is possible to enter a different shipping and billing address, so you can even send a gift from our online store.
  6. If you want to finalize your order, please accept the General Terms and Conditions and if you agree, press the Finalize Order button. Attention element: the final order entails a payment obligation.
  7. If you choose to place an order, you can check the final form of your order and receive confirmation of your order and the essential features of the concluded contract via e-mail.

Note: The user is fully responsible for all orders and other transactions during which his/her username and password were used. In view of this, please ensure that your password is kept confidential. Our company is not liable for any damages resulting from the service being stopped and/or from the loss of any business or private information or other material losses (including in particular material, non-material damage and lost profits).
We inform you that the placed order is considered a pre-order until the start of delivery. When delivery begins, your order will be finalized, of which we will send you a notification by e-mail.

V. Payment
Payment for the goods can be made in cash, cash on delivery, or bank transfer at your discretion. Bank card (online payment) will be available on our website shortly. Optitech Kft. reserves the right to exclude certain payment methods or request advance payment in some cases.

VI. Shipping
Shipping fees
From 2020.08.27 until cancellation, delivery is free throughout the country for orders over a gross value of HUF 50,000. For orders under HUF 50,000, the fee is HUF 1,900 (up to 3 kg). This only partially includes the postage/delivery and packaging fees, the remaining part is covered by the webshop. The fee for heavier packages will be determined separately.
Delivery and collection are possible as follows:
A.) by courier with cash on delivery
B.) in person at our showroom

You must select the delivery / collection method when ordering.

A.) Delivery by courier, cash on delivery
Perhaps the most convenient way to deliver your items is by courier with cash on delivery. The ordered product must be paid to the courier upon receipt of the package. The basic fee for rural areas and Budapest is set out in the delivery fee section. If you requested delivery by courier or post and do not receive the package due to your own fault or through no fault of your own, we reserve the right to pass on the cost of delivery to you regardless of the value.
Courier delivery does not mean destination delivery, i.e. the courier does not deliver the shipment directly from the sender to the recipient, but rather delivers it through a distribution network, usually within 1-2 business days from the date the shipment is handed over to the courier. Delivery takes place on business days (Monday to Friday) between 9 am and 5 pm, but the time cannot be specified more precisely, as the courier travels from address to address. If no one is at the given address at the time of delivery, the courier may not necessarily try to contact the recipient by phone - provided that they have provided their phone number -, but this does not mean that a new delivery address or time can be requested without an additional charge. (Contacting is only for the purpose of ensuring that if the recipient is not at the address for a short time, the courier waits for a few more minutes or hands over the package to his agent.)
We provide the parcels handed over to the courier service with a unique identifier and record their dispatch, so we have accurate information about the fate of each package. If any problem arises with the delivery, e.g. you have not received your package a few days after confirmation, please notify us immediately. Since our products are particularly sensitive to improper, careless handling, when receiving the package, be sure to check the package for damage and unopened condition. The unopened condition is proven by the original "Optitech" adhesive tape. If the box is damaged or opened (the adhesive tape on the box is not Optitech), do not accept the package! A report must be made in the presence of the courier, which both the customer and the courier sign, and a photo may be taken. This is important because if you do not check the package received from the courier upon receipt, you will not be able to enforce any complaints later.

B.) Collection in our showroom in person.
You have the option of collecting the ordered product in person in our showroom, so you can get the product faster and cheaper, touch it, and try it out. If you would like to take advantage of this option, please indicate the possible collection time when ordering. This is important because not all products are always in our showroom, so for your own benefit, be sure to negotiate before collecting in person.

VII. Loyalty program
Become our loyal customer!
Our loyalty program is available to customers who have purchased at least once in our online store, registered by providing their details and signed up for our newsletter. Registered Regular Customers are treated to additional special promotions, preferential prices and extra services from time to time through their own products and our partners.

 
VIII. Warranty and guarantee
We provide a warranty as specified by the applicable laws for all products, which can generally be 6, 12 or 24 months from the date of delivery - unless otherwise provided by law. The exact warranty conditions are always indicated in the description of the given product or on the enclosed warranty card.
 
In the case of certain products and parts, the invoice also serves as a warranty card, we do not provide a separate warranty card. We deliver product information material provided by the manufacturer/distributor with each product.
 
In the event of a product failure, you can receive more information about what to do at the address and telephone number indicated on the warranty letter attached to the device, as well as at one of our contact details. The cost of delivering the products to the warranty service point is borne by the buyer. You can also return the defective device directly to our webshop's service point. Packages sent by courier will not be accepted by our collection point, they will always be returned to the sender!

IX. Right of withdrawal / Termination
The right of withdrawal / termination applies exclusively to users (consumers) who conclude a contract for purposes outside the scope of economic or professional activity. Pursuant to Government Decree 45/2014 (II.26), in the case of off-premises and distance contracts, the consumer has the right to withdraw from the contract without giving any reason within 14 days of the date of purchase. In the case of a contract for the sale of a product: it expires 14 days from the date on which you or a third party other than the carrier indicated by you takes possession of the product.
 
If you wish to exercise your right of withdrawal/termination, you must send a clear statement of your intention to withdraw/termination (for example, by post, fax or electronic mail) to the following address: (1161 Budapest, Rákosi út 131., e-mail. info@optitech.hu). You exercise your right of withdrawal/termination within the deadline if you send your withdrawal/termination statement in a manner that is beyond all doubt and verifiable before the expiry of the deadline specified above.
 
If you withdraw from this contract, we will reimburse you for all payments received from you, including delivery costs, without undue delay and in any event not later than 14 days from the day on which we receive your notification of withdrawal (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery method offered by us). We will use the same payment method as the one used for the original transaction for the refund, unless you have expressly agreed to use a different payment method; you will not incur any additional costs as a result of using this method of refund. You must return or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which we receive your notification of withdrawal to our address (1161 Budapest, Rákosi út 131.). The deadline is considered to have been met if the product is sent before the 14-day deadline has expired. Please note: the costs incurred in returning the goods due to exercising the right of withdrawal are borne by the Buyer.
 
The method of return is as follows: The product must be returned in its original, undamaged condition, together with the invoice and the warranty card, to our location at 1161 Bp, Rákosi út 131. We will only refund the full purchase price if the product is returned undamaged, with complete contents and packaging. Exercising the right of withdrawal does not entail any additional costs for the buyer, however, our customer must arrange for the return of the product, so any shipping or travel costs that may arise are the responsibility of the buyer. Shipping costs cannot be refunded. Unfortunately, we cannot accept the return of the product as a postal package or as a cash on delivery package.
 
Please return the products in any case either in person or by courier. If the returned package meets the above conditions, our Company undertakes to refund the purchase price and shipping costs to the Customer in accordance with the applicable laws.
 
If the product is damaged or not in new condition, our Company reserves the right to compensate for damage resulting from improper use of the product.
 
Free replacement of the given product is only possible if the accessories, do documentation, and their packaging is intact and unopened. Otherwise, the reduced value of the purchase price will be refunded, which is the cost of repackaging by the manufacturer and the replacement of accessories.
 
The consumer may not exercise his right of withdrawal in the cases specified in Section 29 of Government Decree 45/2014 (II.26).
 
The consumer may not exercise his right of withdrawal, according to Section 29 (1) of the Government Decree, in the following cases:
 
a) in the case of a contract for the provision of services, after the performance of the entire service, if the enterprise has begun the performance with the express prior consent of the consumer, and the consumer has acknowledged that he will lose his right of withdrawal after the performance of the entire service;
b) in the case of a product or service whose price or fee cannot be influenced by the enterprise, it depends on possible fluctuations in the financial market even during the period specified in Section 20 (2);
c) in the case of a non-prefabricated product that has been manufactured on the basis of the consumer's instructions or at his express request, or in the case of a product that has been clearly tailored to the consumer;
d) in the case of a perishable product or a product that retains its quality for a short period of time;
e) in the case of a sealed product that cannot be returned after being opened after delivery for health or hygiene reasons;
f) in the case of a product that, by its nature, is inseparably mixed with other products after delivery;
g) in the case of an alcoholic beverage whose actual value depends on market fluctuations in a way that cannot be influenced by the enterprise and whose price was agreed upon by the parties when the sales contract was concluded, but the contract is only performed after the thirtieth day from the conclusion;
h) in the case of a business contract where the enterprise visits the consumer at the express request of the consumer to carry out urgent repair or maintenance work;
i) in the case of the sale and purchase of sealed audio and video recordings and copies of computer software, if the consumer has opened the packaging after delivery;
j) in the case of newspapers, magazines and periodicals, with the exception of subscription contracts;
k) in the case of contracts concluded at a public auction;
l) in the case of contracts for the provision of accommodation, except for residential services, transport, car rental, catering or services related to leisure activities, if a performance deadline or time limit specified in the contract has been stipulated;
m) in the case of digital data content provided on a non-tangible data carrier, if the undertaking has commenced performance with the express prior consent of the consumer and, at the same time as this consent, the consumer has declared his acknowledgement that he will lose his right under Section 20 after commencement of performance. The consumer is only liable for any depreciation resulting from use exceeding the use necessary to establish the nature, characteristics and functioning of the product.
 
When exercising the right of withdrawal, the customer is obliged to act in good faith and to exercise his right in accordance with its purpose. This exercise of the right may not lead to abuse of the right by the customer (Section 5 of the Civil Code). In case of withdrawal, please provide your name and bank account number in your withdrawal statement when sending the package to which you expect the purchase price to be refunded, if you do not return the device in person. X. Customer Service and Complaints Handling

If a dispute arises, the Consumer may first report his/her complaint to our Company (1161 Budapest, Rákosi út 131., by e-mail: info@optitech.hu) or to the regionally competent Conciliation Board. The contact details of the conciliation boards can be found on the website www.bekeltetes.hu (Address: 1016 Budapest, Krisztina krt. 99), as well as on the website of the Hungarian Chamber of Commerce and Industry: www.mkik.hu. In the event of further legal disputes, the parties may contact the competent Municipal Court or the Pest Central District Court. However, we believe that everything between people can be resolved peacefully and amicably.
 
XI. Data protection
The purpose of data processing is to manage the database related to the operation of the webshop, to provide you with information about our products and services, and to ask you questions, send offers and newsletters in order to improve the quality of our products and services.
 
The personal data provided to our Company during the use of the webshop and the finalization of your order are processed by you. 
In the course of our work and activities, your data is processed by our authorized employees (e.g. invoicing, accounting, shipping) to the extent necessary for the tasks.
 
In certain cases, your data may be transferred to third parties. In this case, only and exclusively in order to achieve the specific purpose, such as certain employees of the company operating the website and server (COL Directinfo Kft. 1147 Budapest, Gyarmat u. 99/B), the courier service used for parcel delivery, or the employees of the marketing company used for newsletters and campaigns.
 
After voluntary registration, users can withdraw their consent to data processing at any time with future effect.
 
The time limit for data processing is the date of deletion requested by the user. You can request modification or deletion of your data at any time, which we will fulfill within 15 days at the latest. In this case, please use the unsubscribe button in the newsletter, or send an e-mail to info@optitech.hu, or notify us in any other written form.
 
We do not disclose the personal data of our users to third parties for any purpose without your consent.
While browsing the webshop, technical information is recorded for statistical purposes. (IP address, duration of visit, etc.). This data is processed by our own employees for internal purposes, for the purpose of developing the website. To use the service, cookies must be enabled. If you do not want to allow the use of cookies, you can disable them in your browser settings. If cookies are disabled, certain elements of the service may only be used partially or not at all. A cookie is a file that the server sends to the user's browser and which is stored on the user's computer. No personal data is stored in the cookie. The data recorded during the order process is used to fulfill the order. The invoice data generated by the individual IT systems from orders placed on the webshop pages will be recorded with the data provided during the order placement and stored for the period specified in the effective accounting law.
 
The data provided during the newsletter subscription provided during browsing the webshop will be treated confidentially, the option to unsubscribe is provided at the bottom of each newsletter sent out, and can also be requested at one of the provided contact details.
 
You can request the deletion or modification of your data at any time in writing at the email address info@optitech.hu.
 
In matters not regulated in these general terms and conditions, the provisions of the Civil Code, Government Decree 17/1999 (II.5.) on distance contracts and Government Decree 45.2014 (ll.26.), Act CVIII of 2001 on electronic commerce services and certain issues related to information society services shall apply.
By browsing the webshop pages and placing your order, you accept the general terms and conditions of the contract and the data processing principles, which you can also print out.
 
We hereby inform you that we store your data for the purpose of fulfilling the contract and for later proof of the terms of the contract. Our system may collect data on the activity of users, which cannot be linked to other data provided by users upon registration, nor to data generated when using other sites or services.
 
Our company reserves the right to send information letters to its users, based on the data provided upon registration, in the event of your voluntary consent. Optitech Kft. considers the code of ethics of the Hungarian Advertising Association and the Association of Hungarian Content Providers to be binding on itself. When handling your data, we act in accordance with the Data Protection Act.
 
The user may exercise his/her rights: at the National Data Protection and Freedom of Information Authority (1125 Budapest, Szilágyi Erzsébet fasor 22/c), or at the regionally competent Arbitration Board (www.bekeltetes.hu, Address: 1016 Budapest, Krisztina krt. 99). In the event of further legal disputes, he/she may also contact the competent Municipal Court or the Pest Central District Court.

XII. Legal notice
Our offers include VAT and are valid while stocks last. We are not responsible for any errors or typos, we reserve the right to make changes. For further information, please contact info@optitech.hu. In the case of the mentioned product or company names, the min may be a trademark or brand name of the current owner.
Optitech Kft. is entitled to unilaterally amend these General Terms and Conditions at any time. The amended provisions shall apply to orders placed after their entry into force.

XIV. In case of an extraordinary emergency
Our opening hours may change during an extraordinary emergency, please contact us by e-mail or phone for details. Due to the Corona virus, a state of emergency was declared for the entire territory of Hungary on 2020.03.11 [40/2020. (III.11.) Government Decree], the measures to be taken in the course of it and also in neighboring countries, and the increasingly strict restrictions extended to the entire territory of Italy and several other neighboring and other European Union countries, we must inform you that, according to our current information, the possibility cannot be ruled out that our company will only be able to perform with a delay. It is not foreseeable how the entry ban and two-week home or hospital quarantine ordered by Government Decree 41/2020. (III.11.) will affect professional drivers and the freight transport itself. If the situation that has arisen has an impact on our contractual performance, we will assess the situation as a force majeure circumstance outside our control and unforeseen at the time of conclusion of the contract, during which we could not (were) expected to avoid the circumstance or prevent any possible damage. Of course, we will take all measures expected of us to keep any negative consequences to a minimum.
